Our coalition supports legislation and policies to increase hydrogen fueling infrastructure in California.

Senate Bill 419 would provide an exemption from the state's sales and use tax for hydrogen fuel until January 1, 2023. And unlike gasoline, diesel, alternative fuels and even electricity for battery electric vehicles, hydrogen, specifically zero carbon and renewable hydrogen, is a new entrant to the fuels market. California’s first hydrogen production facilities are being built today and work building an adequate distribution network has not even begun. Nevertheless, there are +14,000 fuel cell vehicles on the road today paying approximately $30 per kilogram for predominantly renewable hydrogen fuel. SB 419 would provide an immediate but short-term boost to early adopters of this technology by reducing fuel costs at the pump.

Assembly Bill 35 would streamline review of clean hydrogen transportation projects under the California Environmental Quality Act (CEQA). This essential step is needed to ensure that California can reduce greenhouse gas emissions, combat climate change and meet development deadlines as specified in the $1.2B federal grant that California has been awarded under the Department of Energy’s clean hydrogen ARCHES program. The current system that guides review processes at the Public Utilities Commission has historically resulted in approval permits to be extremely lengthy and time consuming, along with increased project costs and delays that will prevent California from achieving the climate goals we have set out.

Assembly Bill 716 would ensure the State Fire Marshall adopts the National Fire Protection Association Hydrogen Technologies Code (NFPA 2) for production storage and distribution as well as require the State Fire Marshall to appoint an expert on the issue along with providing ongoing training to local fire departments and building inspectors.
